1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", or "you") and Romaa Entertainments, a company registered under the laws of India, operating the online platform known as BookCineSpace ("Platform", "we", "us", or "our"), with its principal place of business at Romaa Building, Irulapalayam Road, Chennai, Tamil Nadu 600 001.

By accessing or using the BookCineSpace website, mobile application, or any related services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

You represent that you are at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. If you are using the Platform on behalf of a company or organisation, you represent and warrant that you are authorised to bind that entity to these Terms.

2. Platform Description

BookCineSpace is an online marketplace that connects customers ("Customers") with independently operated, privately-owned mini-theatre venues ("Venues" or "Hosts") across India. The Platform enables Customers to search, discover, and book private mini-theatre screening sessions at participating Venue locations.

BookCineSpace is an intermediary platform — we are not a venue operator. All Venues listed on the Platform are owned and operated by independent third-party Hosts who have agreed to list their spaces on BookCineSpace subject to separate Host Terms. Romaa Entertainments facilitates the booking transaction between Customers and Hosts but does not own, manage, control, supervise, or take responsibility for the physical premises, equipment, hygiene, safety, décor, or day-to-day operations of any Venue.

As an online intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, BookCineSpace acts in good faith to provide a safe, accurate, and reliable listing environment but cannot guarantee the accuracy of all Venue information provided by Hosts, nor the experiences customers may have at individual Venues.

Any contract for the provision of venue services is entered into directly between you (the Customer) and the Host. BookCineSpace is not a party to such a contract.

3. Booking & Payments

All bookings made through BookCineSpace are for 3-hour private screening slots at the chosen Venue, unless otherwise explicitly stated on the Venue listing page. Customers may book a maximum number of slots per day as specified in individual Venue listings.

Booking Process:

• Select a Venue, choose your preferred date and time slot, and specify the number of guests (subject to Venue capacity).
• Review the complete pricing breakdown, including all applicable fees, before confirming.
• Complete payment via our secure payment gateway to confirm the booking.
• A booking confirmation will be sent to your registered email address and/or mobile number.

Pricing & Fees:

The total amount payable by the Customer comprises the following components:

• Base Venue Price: Set by the individual Host and displayed on the Venue listing page.
• Platform Service Fee: A fee of 15% of the base venue price, charged by BookCineSpace for facilitating the booking, platform maintenance, customer support, and intermediary services.
• Payment Gateway Fee: A fee of 2% of the total booking value (base price + platform fee), charged to cover transaction processing costs levied by Razorpay, our payment gateway partner.
• GST: Goods and Services Tax as applicable under Indian law (GSTIN: 33BCXPR4393D2Z2) will be applied to the platform service fee component.

Bookings are confirmed only upon successful payment authorisation. In the event of a payment failure, the slot will remain available for other customers. BookCineSpace reserves the right to cancel any booking if payment is not successfully processed.

4. Cancellation & Refund Policy

Customers may cancel confirmed bookings subject to the following tiered refund schedule, calculated based on the time remaining before the commencement of the booked screening slot:

Non-Refundable Component: The platform convenience fee shown at checkout is non-refundable on customer-initiated cancellations. If the venue cannot host your screening (equipment failure, power outage without backup, or host cancellation), you receive a 100% refund including the convenience fee.

How to Cancel: Raise a cancellation request through "Support & Grievance Tickets" on the website or via our WhatsApp concierge, quoting your booking ID. The refund tier is calculated from the time your request is received. Refunds are returned to the original payment method, usually within 5–7 working days.

Refund Processing: Approved refunds will be credited to the original payment source (bank account, UPI, credit/debit card, wallet) within 7 to 10 business days from the date of cancellation, subject to processing timelines of the respective bank or payment service provider.

Venue Cancellations: In the rare event that a Venue Host cancels a confirmed booking, BookCineSpace will endeavour to offer the Customer an alternative equivalent slot or a full refund of the total amount paid, including the payment gateway fee.

No-Show Policy: Customers who do not show up for a confirmed booking without prior cancellation will not be entitled to any refund.

5. Prohibited Uses

By using the BookCineSpace Platform, you agree not to, and represent that you will not:

• Screen, distribute, display, or share any content that is illegal, obscene, defamatory, threatening, or infringes any intellectual property rights, including but not limited to pirated films, unauthorised copies, or content prohibited under the Cinematograph Act, 1952 or any other applicable Indian law.
• Use any Venue for gatherings, events, or assemblies that exceed the maximum seating capacity or occupancy limit stated on the Venue listing, as determined by the Host and relevant local authority regulations.
• Smoke, consume tobacco in any form, or consume alcohol at Venues that expressly prohibit such activities in their listing rules and venue policies. You are responsible for familiarising yourself with the specific rules and restrictions of your chosen Venue prior to booking.
• Use the Platform or any Venue for any unlawful purpose, including but not limited to gambling, solicitation of illegal services, drug use or distribution, or any activity in contravention of Indian Penal Code or other applicable legislation.
• Cause damage to Venue property, equipment, furniture, or décor. Customers shall be personally liable for any damage caused during their booking and may be charged accordingly by the Host.
• Misrepresent the number of guests or intended use of the Venue at the time of booking.
• Conduct any commercial recording, live streaming, or broadcast of content from within a Venue without prior written consent from the Host and the relevant rights holders.
• Attempt to circumvent, disable, or interfere with the security features of the Platform or access any systems beyond your authorised user access.
• Use automated bots, scripts, or scrapers to access or extract data from the Platform.
• Create multiple fraudulent accounts or impersonate any other person or entity.

Violation of any of the above prohibitions may result in immediate termination of your booking without refund, suspension or permanent banning of your account, and may be reported to the relevant law enforcement authorities.

6. Intellectual Property

All intellectual property rights in and to the BookCineSpace Platform — including but not limited to the website, mobile application, software code, database, user interface design, graphics, logos, brand name, trade marks ("BookCineSpace", "Romaa Entertainments"), service marks, and all content created and published by BookCineSpace — are the exclusive property of Romaa Entertainments or its licensors and are protected under applicable Indian and international intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and the Information Technology Act, 2000.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial use in accordance with these Terms. This licence does not permit you to:

• Copy, reproduce, modify, adapt, translate, create derivative works from, or distribute any part of the Platform or its content.
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of any Platform software.
• Remove, obscure, or alter any copyright, trade mark, or proprietary notices contained in the Platform.
• Use BookCineSpace's name, logo, or trade marks in any manner without prior written consent.

Content submitted by Venue Hosts (listings, photographs, descriptions) remains the intellectual property of the respective Hosts. By listing on BookCineSpace, Hosts grant Romaa Entertainments a non-exclusive, royalty-free licence to display, reproduce, and promote such content on the Platform and associated marketing channels.

Any feedback, suggestions, or reviews submitted by Customers shall be considered non-confidential and BookCineSpace reserves the right to use such feedback for platform improvement, marketing, or any other purpose without compensation.

7. Limitation of Liability

To the fullest extent permitted by applicable law, BookCineSpace and Romaa Entertainments expressly disclaim all warranties, whether express, implied, or statutory, relating to the Platform or services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BookCineSpace is a marketplace intermediary platform and is not liable for venue-side issues. Specifically, we are not responsible for:

• The quality, condition, cleanliness, safety, or fitness for purpose of any Venue.
• The accuracy, completeness, or currency of Venue listings, photographs, or descriptions provided by Hosts.
• Any injury, loss, damage, or harm suffered by you or any person accompanying you at or in connection with a Venue booking.
• Equipment failures, power outages, technical malfunctions, or disruptions at a Venue that are outside BookCineSpace's control.
• Acts or omissions of Venue Hosts or their staff.
• Any third-party services accessed through or in connection with the Platform.
• Interruptions, errors, or unavailability of the Platform due to maintenance, cyber attacks, or force majeure events.

Aggregate Liability Cap: In no event shall BookCineSpace's total cumulative liability to you arising out of or in connection with any particular booking transaction — whether in contract, tort (including negligence), statute, or otherwise — exceed the total booking amount actually paid by you for that specific booking. This limitation applies regardless of the form or cause of action.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by applicable Indian law.

8. Governing Law

These Terms and Conditions, and any dispute, claim, or matter arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Republic of India, with particular reference to the laws applicable in the State of Tamil Nadu.

Subject to the dispute resolution process below, the parties irrevocably submit to the exclusive jurisdiction of the competent courts situated in Chennai, Tamil Nadu, India to resolve any disputes arising under or in connection with these Terms.

Dispute Resolution: In the event of any dispute or grievance, we encourage Customers to first contact our support team at bookings@bookcinespace.in or our Grievance Officer at grievance@bookcinespace.in to seek an amicable resolution. BookCineSpace is committed to resolving complaints within 30 days as required under applicable Indian law.

If an amicable resolution cannot be reached, disputes may be escalated to the appropriate Consumer Forum under the Consumer Protection Act, 2019, or to any other applicable regulatory authority.

9. Changes to Terms

BookCineSpace reserves the right to revise, amend, update, or replace these Terms at any time at its sole discretion, including to reflect changes in law, regulation, platform features, or business operations. Any changes will take effect immediately upon posting the revised Terms on this page, with the updated effective date noted at the top.

We will make reasonable efforts to notify registered users of material changes via email or an in-platform notification. However, it is your responsibility to review these Terms periodically. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you must immediately stop using the Platform and may request account deletion as described in our Privacy Policy.
